TLDR:
(covers almost all the basics you need)*Art of Sayankan retains full and exclusive right to the artwork only and not the IP of the character. Client can not claim the original artwork as client’s own.
*Primarily for personal use. Commercial use incurs extra cost(to be negotiated).
***Won’t do: Heavy Gore, NSFW of Minors, Heavy mecha, Detailed background
*To order NSFW Art, the client must be 18 or of the legal age of adulthood of the client's nation or older than that.
*Drawing process may be recorded or live streamed.
*Additional character : +100% base price(+75% for NSFW)
*Pets-Minions-Mounts: Small @+25% base, Medium @+50% base, Big @+100% base(max.)
*Complexity, detailed/extra armor,weapons,limbs,accessories, etc. incur extra cost (to be negotiated)
*We accept payment via Paypal, Payoneer, UPI.
*Payment may be 100% in advance or 50% advance and 50% after sketch approval.
*On receipt of payment, client will be notified shortly on commencement of the commission. If any unfortunate delay occurs due to some unavoidable circumstances, client will be intimated promptly.
*Clients will periodically be updated on progress of commission containing watermarked WIPs, progress photographs. It is requested that necessary inputs (revisions, suggestions, acceptance etc.) may be communicated, as the next stage of work will only be initiated after that.
*Major revisions are limited to 3 free of cost at sketch stage. After the sketch is approved by the client, only minor revisions like color change can be accommodated. Anything else will incur extra fee and time. The amount of the fee depends on the change the client wants to make
*On completion, clients will be provided with full resolution image in PNG along with its lower tier versions( eg. for a fully colored piece, lineart and flat colored pieces will also be provided) in PNG/ transparent PNG as per the artwork. No physical product will be delivered.
*Art of Sayankan has the right to reject any order on valid grounds
____________________________By commissioning Art of Sayankan, you are stating that you have read and agreed to these termsA) General Terms and Rights:1. Art of Sayankan retains full and exclusive right to the artwork only and not the IP (Intellectual Property) of the character. Client can not claim the original artwork as client’s own.2. Any commercial use of the artwork must be according to the agreement with Art of Sayankan. Clients can, however, use it, with due credit to the artist, for youtube/ streaming/ social media where monetisation may occur unless monetisation is largely/ solely based on the artwork. In the latter scenario, it will be viewed as commercial use.3. Once commissioned for personal use, clients can later use it for commercial purposes upon paying the commercial rights of the artwork.4. Any fan-art made by Art of Sayankan can not be used for commercial purposes unless the client has the IP. Art of Sayankan will not be responsible for a client's violation of IP.5. Artwork may or will include a subtle sign not to be removed/altered without prior permission of the artist, that to be on valid ground .6. Art of Sayankan is allowed to use the artwork for Portfolio/Patreon and post it in social media unless agreed upon otherwise on valid ground. However, posting the artwork can be delayed under special circumstances (gifts, NDA, personal exclusive art).7. Drawing process may be recorded or live streamed. This too may be negotiated to be delayed under special circumstances.8. Art of Sayankan reserves the full rights to the image and its use/distribution, which includes but not limited to promotion, profile, artbook, social media, livestream, any platform etc., unless otherwise agreed upon.9. Prices are subject to change. Please see the Price List.10. Art of Sayankan has the right to reject any order that does not feel comfortable drawing for any reason.11. To order NSFW Art, the client must be 18 or of the legal age of adulthood of the client's nation or older than that. By ordering NSFW art, the client is agreeing to this term. This can never be negotiated and Art of Sayankan will not be responsible for the client's illegal activity.12. Art of Sayankan strictly prohibits use of commissioned artwork for AI or NFT (as per the terms commonly used for).B) Workflow and Delivery:1. On receipt of payment, client will be notified shortly on commencement of the commission. If any unfortunate delay occurs due to some unavoidable circumstances, client will be intimated promptly.2. Minimum ‘Turn-around-time’ (TAT) for a single slot is 14 days.This may extend depending on factors like complexity/scale of artwork, work-load, queue, life-situations. Generally, the main bulk of work i.e., detailed lines, shading etc. is done on weekends.3. Clients will periodically be updated on progress of commission containing watermarked WIPs, progress photographs. It is requested that necessary inputs (revisions, suggestions, acceptance etc.) may be communicated, as the next stage of work will only be initiated after that.4. Major revisions are limited to 3 free of cost at sketch stage. After the sketch is approved by the client, only minor revisions like color change can be accommodated. Anything else will incur extra fee and time. The amount of the fee depends on the change the client wants to make.5. Basic canvas size will be a3 ( 3508 pixels x 4961 pixels) at 300 DPI. This can be customisable upon discussion.6. Color profile is RGB.7. Each additional character costs +100% of the price for one in most cases; for NSFW it costs +50% to +75% depending upon the artwork.8. In case of ‘Pets-Minions-Mounts(PMM)’ it incurs Small @+25% base, Medium @+50% base, Big @+100% base(max.). In case of monsters, cost of a hero facing the monster may be considered as small/medium/big PMM depending on the complexity.9. Complexity, detailed/extra armor,weapons,limbs,accessories, etc. incur extra cost.10. On completion, clients will be provided with full resolution image in PNG (if client wishes TIFF format can also be provided) also with its lower tier versions( eg. for a fully colored piece, lineart and flat colored pieces will also be provided) in PNG/ transparent PNG as per the artwork. No physical product will be delivered.C) Cancellation and Refund:1. The client is not allowed a refund once working on the commission has commenced.2. If artist feels unable to capture a client's request, partial refund may be arranged but only on the artist's sole authority. The artwork, in its present state, will be owned by Art of Sayankan completely and client can not use any WIP/ process image/ lines/sketches, even for personal use.3. If for any reason Art of Sayankan is unable to start commission, the client is entitled to a full refund. However, this will only be accepted after deliberation between artist and client.4. If the client cancels the order before the artist has started it, the client is entitled to a full refund.5. In case of receiving a refund, Art of Sayankan will transfer the money back to the client. Requesting a paypal chargeback will be declined.Most of these terms are open to negotiation prior to finalizing commission agreement and payment.Post-agreement (written or otherwise) violation of any terms will result in the client losing his/her/their rights to the artwork.
